"Service" refers to the Exitus Legal compliance platform, including the withdrawal button widget, audit logging system, PDF durable medium generation, and the merchant dashboard. "Merchant" or "You" refers to the individual or business entity using our Service. "Consumer" refers to end-users who interact with the withdrawal button on your website. "We," "Us," or "Our" refers to Exitus Legal.
Exitus Legal provides an automated EU consumer withdrawal compliance solution. Our service includes a JavaScript widget that renders a compliant withdrawal button on your website, captures consumer withdrawal requests, generates PDF durable medium confirmations, and maintains audit logs as required by EU Directive 2011/83/EU.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
Our services are offered on a subscription basis. Fees are billed monthly or annually depending on your chosen plan. All prices are in Euros (€) and exclude applicable taxes unless stated otherwise.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods unless required by applicable EU consumer protection law.
As a merchant, you are responsible for correctly installing the Exitus Legal widget on your website, ensuring it remains accessible on all relevant pages, and responding to consumer withdrawal requests in accordance with applicable EU law. Our service facilitates compliance but does not constitute legal advice.
We act as a data processor on your behalf when processing consumer withdrawal data. Our processing activities are governed by a Data Processing Agreement (DPA) in accordance with GDPR Article 28. You remain the data controller for consumer data collected through our widget.
All content, code, design, and materials provided through our service are the intellectual property of Exitus Legal. You are granted a limited, non-exclusive license to use the widget on your website for the duration of your subscription.
Exitus Legal shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount paid by you for the service during the 12 months preceding the claim. Nothing in these terms excludes liability for death, personal injury, or fraud.
Our service is designed to help you comply with EU withdrawal regulations but does not guarantee full legal compliance. We recommend consulting with a qualified legal professional for specific legal advice. The service is provided "as is" without warranties of any kind, either express or implied.
We may suspend or terminate your access to the service if you violate these terms. Upon termination, your right to use the service ceases immediately. Audit logs and withdrawal records will remain available for download for 30 days after termination.
These terms are governed by the laws of the European Union and the applicable national laws. Any disputes shall be submitted to the competent courts. Nothing in these terms affects your statutory rights as a consumer under EU law.
We reserve the right to modify these terms at any time. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the service after changes take effect constitutes acceptance.
